The rare 1940 double-bill release ("Plus second action thriller!") of You're Not So Tough, the 1940 Joe May New York City juvenile delinquent crime thriller starring The Dead End Kids and The Little Tough Guys (before this, some of the Dead End Kids had split off into a separate group called "The Little Tough Guys", but they joined back together for this movie; including Billy Halop, Huntz Hall, Bobby Jordan, and Gabriel Dell), Nan Grey, Bernard Punsly, Henry Armetta, Rosina Galli AND Lucky Cisco Kid, the 1940 H. Bruce Humberstone cowboy western ("A rival bandit steals his name! A crooked judge frames him! A senorita crosses him up!"; "Based on the character 'The Cisco Kid' created by O. Henry") starring Cesar Romero (in the title role as The Cisco Kid), Mary Beth Hughes, Dana Andrews, Evelyn Venable, and Chris-Pin Martin.

The Merrick Theater was a single-screen movie house built by architects R. Thomas Short and William Rau. The theater was located at 163rd Street and Jamaica Avenue in the Jamaica section of Queens and opened in January 1921 with a seating capacity of 2,500. Unfortunately, even with the large seating it was only the third largest theater in the neighborhood, behind the Loew's Valencia Theatre and Loew's Hillside Theatre. The Merrick was also not connected with any major studios, so it didn’t get the latest first-run movies.
